Chalking Guidelines:

1. Michigan Technological University shall allow chalking provided that
  a. It takes place on concrete sidewalks; not on buildings, steps, or other University-owned property.
  b. The message/artwork is signed or otherwise recognizes the member of the University community sponsoring it.
    note: member of the university community shall be defined as any recognized student group, department, staff member, faculty member, or registered member of Michigan Technological University.
  c. The message is not directed as a threat to any other member of the University community.
    1) A threat shall be defined to have occurred any time that an individual or group in the campus community feels that their health and safety has been jeopardized.
    2) Any and all threatening messages shall be removed immediately.
  d. The material, taken as a whole, contains serious literary, artistic, political, or scientific value.
  e. The chalking in no way defaces or alters a previous chalking.

2. If a chalking is found to be defacing/altering a previously placed chalking:
  a. The group/individual who's chalking was defaced shall be contacted or shall contact the University and be notified that the defacement has occurred.
  b. The group/individual shall be presented with the following options:
    1) Immediate removal of the defacing chalkings.
    2) Removal of the defacing chalking after a period of 24 hours.
    3) No removal of the defacing chalkings.

3. If the chalking is not signed and/or clearly sponsored by a member of the University community, only Facilities Management shall be empowered to remove it immediately.

4. The only material that may be used to mark on the sidewalks shall be water soluble chalk (commonly known as "sidewalk chalk").
  a. The following materials shall not be allowed on the sidewalks:
    1) Oil-based chalk
    2) Paint (including water-based, oil-based, and acrylics)
    3) Hairspray or lacquer (sometimes used as a fixative)
    4) Any other permanent material

5. Reporting complaints related to chalking messages.
  a. Complaints can be made to any of the following University offices:
    1) Student Affairs
    2) Public Safety
    3) Facilities Management
  b. In incidents where the chalking has defaced/altered a previous message, the Office of Student Affairs will contact the group or individual to ascertain what option they choose under 2B.
  c. In incidents where one member of the University community has lodged a complaint about another member's message, the Office of Student Affairs shall attempt to initiate a mediation session between the two parties in order to bring some means of resolution to the complaint.
  d. When a complaint has been lodged, the Office of Student Affairs, in consultation with the complainant and the Affirmative Action Office, can distribute a campus advisory describing the nature of the complaint and rearticulating the tenets of the chalking policy as it relates to freedom of expression in an educational environment.

6. Members of the University community who fail to comply with this policy can be charged with defacing University property and these organizations may be subject to loss of recognition.
