Chapter 7 - Obedience to Traffic Regulations

Sec. 7.1 Required Obedience to Traffic Ordinance

It is a violation of this ordinance for any person to do any act forbidden or fail to perform any act required herein.

Sec. 7.2 Obedience to Police and Fire Department Officials

No person shall willfully fail or refuse to comply with any lawful order or direction of any police officer, or member of the fire department at the scene or in the immediate vicinity of a fire, who is vested with authority under this ordinance to direct, control, or regulate traffic.

Sec. 7.3 Persons Propelling Push Carts or Riding Animals to Obey Traffic Regulations

Every person propelling any push cart or riding an animal upon a roadway, and every person driving any animal-drawn vehicle, shall be subject to the provisions of this ordinance applicable to the driver of any vehicle, except those provisions of this ordinance which by their very nature can have no application.

Sec. 7.4 Use of Coasters, Roller Skates and Similar Devices Restricted

No person upon roller skates, or riding in or by means of any coaster, toy vehicle, or similar device, shall go upon any roadway except while crossing a street on a crosswalk and when so crossing such person will be granted all of the rights and shall be subject to all of the duties applicable to pedestrians.

Sec. 7.5 Authorized Emergency Vehicles

The driver of an authorized emergency vehicle, when responding to an emergency call or when in the pursuit of an actual or suspected violator of the law or when responding to but not upon returning from a fire alarm, may exercise the privileges set forth in Section 7.6.

Sec. 7.6 Privileges of Authorized Emergency Vehicles

The driver of an authorized emergency vehicle may:

  1. Park or stand, irrespective of the provisions of this ordinance;

  2. Proceed past a red or stop signal or stop sign, but only after slowing down as may be necessary for safe operation;

  3. Exceed the prima facie speed limits so long as he does not endanger life or property;

  4. Disregard regulations governing direction of movement or turning in specified directions;

  5. Drive through a parade or other authorized procession.

Sec. 7.7 Signal Required

The privileges herein granted to an authorized emergency vehicle shall apply only when the driver of any said vehicle while in motion sounds audible signal by bell, siren or exhaust whistle as may be reasonably necessary, and when the vehicle is equipped with at least 1 lighted lamp displaying a flashing, oscillating or rotating red or blue light visible under normal atmospheric conditions from a distance of 500 feet to the front of such vehicle, except that an authorized emergency vehicle operated as a police vehicle need not be equipped with or display a red or blue light visible from in front of the vehicle.

Sec. 7.8 Authorized Emergency Vehicle Driver Responsibility

The foregoing provisions shall not relieve the driver of an authorized emergency vehicle from the duty to drive with due regard for the safety of all persons, nor shall such provisions protect the driver from the consequences of his reckless disregard for the safety of others.

Sec. 7.9 Obedience to Official Traffic-Control Devices

The driver of any vehicle shall obey the instructions of any official traffic-control device applicable thereto placed in accordance with the traffic ordinances of Michigan Technological University unless otherwise directed by a police officer.

Sec. 7.10 Stopping on Direction of Officer

No driver of a motor vehicle who is given by hand, voice, emergency light or siren a visual or audible signal by a police or Public Safety Department officer, acting in the lawful performance of his duty, directing the driver to bring his motor vehicle to a stop, shall willfully fail to obey such direction, by increasing his speed, extinguishing his lights, or otherwise attempting to flee or elude the officer. The officer giving the signal shall be in uniform; and the vehicle driven shall be adequately identified as an official police or Public Safety Department vehicle.

Sec. 7.11 Parking and Traffic Exemptions

The drivers of such University owned or operated vehicles or other vehicles as may be designated by the Executive Vice President and Provost shall be exempted from the payment of fees and/or the restrictions imposed by Sections 3.26, 3.27, 3.29, 3.52, 3.54, 3.55, 3.56, 4.1, 4.2, 5.7.1., 5.11, 5.14, 5.16, 5.17, 5.18, 5.19, and 9.3 when said drivers are operating such designated vehicles in the course of performing their official duties or when in the opinion of the Provost and Senior Vice President for Academic and Student Services such exemption would, consistent with prevailing traffic safety practice, be in the best interests of the University.

Sec. 7.12 Authorized Maintenance and Snow Removal Vehicles - Privileges

The driver of an authorized maintenance, snow removal or ice control vehicle during the course of performing his maintenance, snow removal or ice control duties may exercise the privileges set forth below:

  1. Park or stand, irrespective of the provisions of this ordinance;

  2. Disregard regulations governing direction of movement or turning in specified directions.

Sec. 7.13 Authorized Maintenance and Snow Removal Vehicles - Lighting Required

The privileges granted herein to maintenance, snow removal and ice control vehicles shall apply only when the vehicle is equipped with 1 lighted lamp displaying a flashing, oscillating or rotating amber light placed in such position on the vehicle as to be visible throughout an arc of 360 degrees.

Sec. 7.14 Authorized Maintenance and Snow Removal Vehicles Responsibility

The foregoing provisions shall not relieve the driver of an authorized maintenance, snow removal or ice control vehicle from the duty to drive with due regard for the safety of all persons, nor shall such provisions protect the driver from the consequences of his reckless disregard for the safety of others.
