The Manager of the Public Safety Department and/or the Director of the Division of Facilities Management or their designees, when so authorized by the Provost and Senior Vice President for Academic and Student Services, shall establish such traffic controls, signs and signals on the streets and property of the campus as may be necessary for the proper regulation and control of vehicular traffic and pedestrians and such traffic control signals and signs shall conform to and be in accordance with Michigan Uniform Traffic Code, as amended and as promulgated pursuant to the provisions of Act 62 of the Public Acts of 1956.
Every driver of a vehicle approaching a stop sign shall stop before entering the crosswalk on the near side of the intersection, or in the event there is no crosswalk, shall, stop at a clearly marked stop line, but if none, then at the point nearest the intersecting roadway where the driver has a view of approaching traffic on the intersecting roadway before entering the intersection and shall proceed into the intersection only when such movement can be made in safety and without interfering with other traffic, except when directed to proceed by a police officer or traffic-control signal.
The driver of a vehicle emerging from an alley, driveway, or building shall stop such vehicle immediately prior to driving onto a sidewalk or onto the sidewalk area extending across any alleyway, yielding the right-of-way to any pedestrian as may be necessary to avoid collision, and upon entering the roadway, shall yield the right-of-way to all vehicles approaching on said roadway.
No driver shall enter an intersection or crosswalk unless there is sufficient space on the other side of the intersection or crosswalk to accommodate his vehicle without obstruction or blocking the passage of other vehicles or pedestrians notwithstanding any traffic control signal indication or other right to proceed.
Whenever any person driving a vehicle approaches a railroad grade crossing under any of the circumstances stated in this section, the driver of such vehicle shall stop within 50 feet but not less than 15 feet from the nearest rail of such railroad, and shall not proceed until he can do so safely. The foregoing requirements shall apply when:
No person shall drive any vehicle through, around, or under any crossing gate or barrier at a railroad grade crossing while such gate or barrier is closed or being opened or closed.
When 2 vehicles enter an intersection at approximately the same time, the driver of the vehicle on the left shall yield the right-of-way to the vehicle of the right except as otherwise provided in this ordinance. The driver of any vehicle traveling at an unlawful speed shall forfeit any right-of-way which he might otherwise have hereunder.
Where signs bearing the message "yield right-of-way" are erected upon the approach to an intersection, a driver approaching such sign shall slow to a reasonable speed for existing conditions of traffic and visibility, yielding the right-of-way to all traffic on the intersecting street which is so close as to constitute an immediate hazard. The driver of any vehicle traveling at an unlawful speed shall forfeit any right-of-way which he might otherwise have hereunder.
The driver of a vehicle within an intersection intending to turn to the left shall yield the right-of-way to any vehicle approaching from the opposite direction which is within the intersection or so close thereto as to constitute an immediate hazard, but said driver, having so yielded and having given a signal when and as required by this ordinance, may make such left turn and the drivers of all other vehicles approaching the intersection from said opposite direction shall yield the right-of-way to the vehicle making the left turn: Provided, that an intersection at which a traffic signal is located, a driver intending to make a left turn shall permit vehicles bound straight through in the opposite direction which are awaiting a go signal to pass through the intersection before making the turn.
Upon the immediate approach of an authorized emergency vehicle equipped with at least one (1) lighted flashing, rotating or oscillating lamp exhibiting a red or blue light visible under normal atmospheric conditions from a distance of five hundred (500) feet to the front of such vehicle, and when the driver is giving audible signal by siren, exhaust whistle, or bell, the driver of every other vehicle shall yield the right-of-way and shall immediately drive to a position parallel to, and as close as possible to, the right edge or curb of the roadway (or left edge on a one-way street) clear of any intersection and shall stop and remain in such position until the authorized emergency vehicle has passed, except when otherwise directed by a police officer.
No procession or parade shall occupy, march, or proceed along any roadway except in accordance with a permit issued by the Manager of the Public Safety Department.
Upon all roadways of sufficient width a vehicle shall be driven upon the right half of the roadway, except as follows:
Drivers of vehicles proceeding in opposite directions shall pass each other to the right, and upon roadways having width for not more than 1 line of traffic in each direction each driver shall give to the other at least 1/2 of the main-traveled portion of the roadway as nearly as possible.
The following rules shall govern the overtaking and passing of vehicles proceeding in the same direction subject to those limitations, exceptions, and special rules hereafter stated:
The driver of a vehicle may overtake and pass upon the right of another vehicle only under the following conditions:
No vehicle shall be driven to the left side of the center of a 2-lane street or in the center lane of a 3-lane street in overtaking and passing another vehicle proceeding in the same direction unless such left side or center lane is clearly visible and is free of oncoming traffic for a sufficient distance ahead to permit such overtaking and passing to be completely made without interfering with the safe operation of any vehicle approaching from the opposite direction or any vehicle overtaken.
No vehicle shall at any time be driven to the left side of the roadway under the following conditions:
The driver of a vehicle shall not overtake and pass any vehicle in a no passing zone where official signs or markings on the roadway indicate the beginning and end of such zone and when such signs or markings are in place and clearly visible to an ordinarily observant person.
Upon a roadway or alley designated and sign posted for 1-way traffic a vehicle shall be driven only in the direction designated.
A vehicle passing around a rotary traffic island shall be driven only to the right of such island.
Whenever any roadway has been divided into 2 or more clearly marked lanes for traffic the following rules in addition to all others consistent herewith shall apply:
The driver of a motor vehicle shall not follow another vehicle more closely than is reasonable and prudent, having due regard for the speed of such vehicle and the traffic upon and the condition of the street.
The driver of any vehicle other than an authorized emergency vehicle on official business shall not follow any fire apparatus traveling in response to a fire alarm closer than 500 feet or drive into or park such vehicle within 500 feet where fire apparatus has stopped in answer to a fire alarm.
The driver of a vehicle intending to turn at an intersection shall do so as follows:
Both the approach for a right turn and a right turn shall be made as close as practicable to the right-hand curb or edge of the roadway.
At any intersection where traffic is permitted to move in both directions on each roadway entering the intersection, an approach for a left turn shall be made in that portion of the right half of the roadway nearest the center line thereof and by passing to the right of such center line where it enters the intersection and after entering the intersection the left turn shall be made so as to leave the intersection to the right of the center line of the roadway being entered. Whenever practicable the left turn shall be made in that portion of the intersection to the left of the center of the intersection.
No driver of a vehicle shall turn a vehicle at any intersection except when such movement can be made in safety and without interfering with other traffic and as directed by established pavement markers, signs or signals placed within or adjacent to said intersection.
Whenever authorized signs are erected indicating that no right or left or U turn is permitted, no driver of a vehicle shall disobey the directions of any such sign.
No person shall drive any motor vehicle upon other than established roadways, streets, alleys, driveways, or parking areas.
The driver of a vehicle shall not back the same unless such movement can be made with reasonable safety and without interfering with other traffic.
No person shall drive any motor vehicle upon any sidewalk, grass or lawn area, playing field, running track, or any other area not included as allowable under Sec. 3.27.
Every person riding a bicycle upon a roadway shall be granted all of the rights and shall be subject to all of the duties applicable to the driver of a vehicle by the state laws of Michigan declaring rules of the road applicable to vehicles or by this ordinance applicable to the driver of a vehicle, except as to special regulations in this chapter and except as to those provisions of laws and ordinances which by their nature can have no application.
No person shall operate any bicycle upon other than established roadways, alleys, parking areas, sidewalks, or bicycle paths.
Whenever any person is riding a bicycle upon a sidewalk, such person shall yield the right-of-way to any pedestrian and shall give audible signal before overtaking and passing such pedestrian.
Any person driving a vehicle on a street or alley shall drive the same at a careful and prudent speed not greater than nor less than is reasonable and proper, having due regard to the traffic, surface and width of the street or alley and of any other condition then existing, and no person shall drive any vehicle upon a street or alley at a speed greater than will permit him to bring it to a stop within the assured, clear distance ahead.
Subject to the provisions of section 3.33 and except in those instances where a different speed is lawfully established and posted, it shall be prima facie lawful for the driver of a vehicle to drive the same at a speed not exceeding 15 miles an hour on all streets and alleys, but in any case when such speed would be unsafe it shall not be lawful.
It shall be prima facie unlawful for any person to exceed any of the speed limitations set forth in section 3.34.
It shall be prima facie unlawful to exceed the speed stated on signs erected in accordance with this ordinance.
In every charge of violation of the speed restrictions in this ordinance, the violation card shall specify the speed at which the defendant is alleged to have driven, also the speed applicable within the district or at the location.
Every driver of a vehicle shall exercise due care to avoid colliding with any pedestrian or vehicle upon any street, alley, or area open to motor vehicles.
Every person operating a motorcycle or moped upon a street shall be granted all the rights and shall be subject to all the duties applicable to the driver of a vehicle under this ordinance, except as to those provisions which by their nature have no application.
The operators of motorcycles or mopeds shall not ride more than two abreast on any street and shall comply with the seating and control requirements as may be provided by this ordinance or by the Michigan Uniform Traffic Code.
No person riding upon any bicycle, motorcycle, moped, coasters, roller skates, ski, sled, or toy vehicle shall attach the same or himself to any vehicle upon a roadway.
No person shall use the streets or alleys for travelling on skis, toboggans, sleds, coasters, roller skates, toy vehicles, or similar devices. No person shall use any street or alley within the campus of Michigan Technological University as a sled or ski course for the purpose of coasting on sleds, skis or other similar devices, except for portions of such streets officially set aside for such use by the Provost and Senior Vice President for Academic and Student Services or designee, and adequately roped off or otherwise marked for such purpose.
No person shall drive a vehicle when it is so loaded or when there are in the front seat such a number of persons as to obstruct the view of the driver to the front or sides of the vehicle or so as to interfere with the driver's control over the driving mechanism of the vehicle.
No passenger in a vehicle shall ride in such position so as to interfere with the driver's view ahead or to the sides, or to interfere with his control over the driving mechanism of the vehicle.
No person shall drive any motor vehicle with a window so damaged or any sign, poster or other non-transparent material upon the front windshield, side wings, side or rear windows of such vehicle so as to obstruct the driver's view other than a decal, certificate, or other paper required to be so displayed by law.
No vehicle shall be driven over any unprotected hose of a fire department without the consent of the fire department official or police officer in command.
No person shall board or alight from any vehicle while such vehicle is in motion.
The driver of a vehicle shall not at any time drive through or over a safety zone when such safety zone contains any person thereon.
No driver of a motor vehicle shall recklessly, willfully, wantonly, or carelessly operate his vehicle in such manner as to splash snow, rain, water, mud, dirt, or debris on any person then upon a sidewalk, crosswalk, or safety zone.
No person shall throw or deposit upon any street any glass bottle, glass, nails, tacks, wire, cans, rubbish, garbage or any other substance likely to injure any person, animal, or vehicle upon such street. Any person who drops, or permits to be dropped or thrown, upon any street any destructive or injurious material shall immediately remove the same or cause it to be removed.
Any person removing a wrecked or damaged vehicle from a street shall remove any glass or other injurious substance dropped upon the street from such vehicle.
No vehicle shall be driven or moved on any street unless such vehicle is so constructed or loaded as to prevent its contents from dropping, sifting, leaking, or otherwise escaping therefrom.
No person having control or charge of a motor vehicle shall allow such vehicle to stand on any street unattended without first effectively setting the brakes thereon and stopping the motor of said vehicle and when standing upon any grade without turning the front wheels to such vehicle to the curb or side of the street.
Every motor vehicle shall at all times be equipped with a muffler in good working order and in constant operation to prevent excessive noise and annoying smoke and no person shall operate on the streets a motor vehicle equipped with a muffler cut out, by-pass or similar device, or a device for the purpose of causing flame or smoke to be emitted from a vehicle.
The engine and power mechanism of every motor vehicle shall be so quipped and adjusted as to prevent the escape of excessive fumes or smoke.
No person shall drive or move and no owner shall cause or knowingly permit to be driven or moved on the campus any vehicle or combination of vehicles which is in such unsafe condition as to endanger any person, or which does not contain those parts or is not at all times equipped with such lamps and other equipment in proper condition and adjustment as required by Michigan Motor Vehicle Code, Act 300, Public Acts of 1949, as amended, or which is equipped in any manner in violation of this ordinance.
No person shall operate a vehicle upon a highway or a frozen public lake, stream or pond or other place open to the general public, including any area designated for the parking of vehicles, in a careless or negligent manner likely to endanger any person or property.
No person, without authority, shall block, obstruct, impede or otherwise interfere with the normal flow of vehicular or pedestrian traffic on the campus by means of a barricade, object or device, or with his person. This section shall not apply to persons maintaining, rearranging or constructing University or utility facilities in or adjacent to a street or highway.
No snow vehicle, snowmobile, all terrain vehicle, or other such device not licensed for operation on public thoroughfares will be operated, driven, towed (without trailer), or otherwise used on University property without the express written consent of the Provost and Senior Vice President for Academic and Student Services or the Manager of the Public Safety Department.
No person operating a bicycle, motorcycle or moped shall carry any package, bundle or article which prevents the driver from keeping both hands upon the handlebars of said vehicle.
A bus, for the purpose of taking on or discharging passengers, may be stopped at a place described in section 5.7, 2., 4., or 6., on the roadway side of a vehicle illegally parked in a legally designated bus loading zone, or at a place described in section 5.716. if the place is posted by an appropriate bus stop sign, except that a bus shall not stop at such a place if the stopping is specifically prohibited by the Public Safety Department.
