Each violator shall, unless authorized or directed under state law to the contrary, be presented by the complaining officer or anyone making a complaint for a violation of this Ordinance with a violation card which shall state the nature of the violation, name of officer or person making the complaint, and the car make and license number. Such violation card shall direct the violator to report to the Parking Violations Bureau of Michigan Technological University in the case of violation of Chapter 5 (Parking) of this ordinance and to a Magistrate of the 97th District Court, Houghton, Michigan, in the case of violation of any other provision of this ordinance. The violator shall have the option of paying the fines prescribed for the violation charged or appearing before such court and responding in accordance with state law. If the violator fails to appear in accordance with the notice given, a complaint will be made in the court designated and the case shall be processed in the usual manner before said Court.
Every University safety officer, unless directed by state law to the contrary, upon issuing a violation card shall submit duplicate copies of the corresponding violation card and complaint to the Manager of the Public Safety Department or his authorized agent and in the event of a violation of Chapter 5 (Parking) hereof to the Parking Violations Bureau.
Any person who has received a parking violation card (Chapter 5 hereof) as provided in this ordinance, shall within the time specified in such notice, answer at the Parking Violations Bureau of Michigan Technological University for the charges set forth in such notice by admitting responsibility to the infraction and by paying to the cashier in the Parking Violation Bureau a fine prescribed by the Provost and Senior Vice President for Academic and Student Affairs for the infraction or if responsibility is denied such person shall inform the clerk of the Parking Violations Bureau of their intent to deny responsibility before the 97th District Court. Acceptance of this fine so paid shall be deemed complete satisfaction for the infraction and the violator shall be given a receipt for the amount paid. Such fine shall not exceed twenty-five dollars ($25.00) for any single offense.
All fines and penalties are due and payable within five (5) days of the date the violation card is issued.
The Parking Violation Bureau shall receive all moneys paid for violations of Chapter 5 hereof in accordance with and as provided for by this ordinance and shall issue receipts to all persons from whom money has been collected. The Business Office shall keep records of all fines so paid and such records shall be audited in the manner prescribed by the Board of Control of Michigan Technological University.
All violation fees for the violation of Chapter 5 hereof are payable at the Parking Violations Bureau, located at the cashier's office, Business Office, First Floor, Administration Building, Houghton, Michigan.
After five (5) days, all unpaid parking violations may be delivered to the District Court or such other appropriate court for enforcement in accordance with its ordinary rules and procedure.
In the event that a complaint and warrant for any violation under this ordinance shall be filed for enforcement by the District Court or other appropriate court, the fine prescribed by the Provost and Senior Vice President for Academic and Student Affairs shall be applied by such court as a minimum fine. In the event of hardship, the court may suspend the minimum fine, or in the event such violation merits a fine greater than the minimum, the court may levy a greater fine and/or imprisonment not to exceed that allowed by law. In the event such violator has failed to appear in court and a warrant has been issued, the court may levy in addition to the fine, a warrant fee in accordance with the regular authority and practice of the court.
The Manager of the Public Safety Department shall be responsible for the issuance of books of violation cards and shall maintain or shall cause to be maintained a record of every such book and each set of violation cards contained therein issued to the individual members of the Public Safety Department and shall require and retain a receipt for every book so issued.
