Formal Complaint Process:
If all informal efforts have been exhausted without resolution, or if the AAO or any party involved in the complaint chooses, the complaint may be taken into a formal process. Formal charges must be written and signed by the party requesting the process.
If further investigation is required, corroboration of events will be sought from both parties and relevant witnesses may be interviewed.
As in the informal method the AAO may convene an ad hoc advisory group to assist the AAO with the case. If such a committee is formed, as much as possible, the membership will be representative of the parties involved.
Both parties will be advised of the results of the investigation. At this point efforts may be made to settle differences between the parties. If not successfully resolved, the complainant and respondent will be advised of the outcome and how Michigan Tech will respond.
Possible outcomes of the information gathering/formal investigation may include:
- If the charges are substantiated, the AAO will notify both parties of the findings. The AAO will also notify appropriate members of the administration, who will determine the appropriate action.
- If the charges are determined not to be discrimination or discriminatory harassment, the AAO will present the findings in writing to the parties. The complaint will be dismissed. Appropriate personnel will be notified as needed.
Formal Appeal
If either party is not satisfied with resolution attempts at the first formal level, the issue may go to a formal appeal step. The formal appeal is made in writing to the President.
Within 10 working days of receipt of the appeal to the office, the President will consult with the AAO and the appropriate Vice President to convene a hearing panel. The panel will hear the case and recommend to the President what, if any, actions to be taken. The panel may request additional investigative steps if necessary including conducting interviews. The AAO will work with the President and the panel upon request.
- If the charge is substantiated, the panel may refer to the President for appropriate corrective and/or disciplinary action.
- If the charge is not substantiated, the panel may recommend dismissal of the case.
The president will receive the recommendations of the panel and will issue a decision.
